At the end of the course, students are able to:

1 Menjelaskan falsafah, konsep dan kedudukan sistem kehakiman (al-qada’) Islam,
perjawatan berkaitan kehakiman serta kaitannya dengan keadilan
Explain the philosophy, the concept of the Islamic judiciary system (al-qada'), judicial
personnel and their relation to justice.
2 Mengenalpasti institusi yang berkaitan dengan sistem keadilan seperti al-hisbah, al-mazalim,
al-sulh dan al-tahkim
Identify several institutions related to the justice system such as the al-hisbah, al-mazalim,
al-sulh and al-tahkim.
3 Mengenalpasti konsep pendakwaan, kaedah pembuktian dan hukuman
Identify the concept of prosecution, method of proving and punishment.
4 Mengaplikasikan teori kehakiman Islam dalam profesion kehakiman dan perundangan Islam
di Malaysia.
Apply the theory of Islamic judiciary system in the Islamic judicial dan legal profession in
Malaysia.
Sinopsis Kandungan Kursus / Synopsis of Course Content

Kursus ini membincangkan konsep al-qada’, dalil, latar belakang serta kaitannya dengan kewajiban
menegakkan keadilan. Ini diikuti dengan syarat dan kelayakan bagi kakitangan mahkamah.
Perbincangan juga meliputi institusi yang ada kaitan dengan kehakiman seperti al-hisbah, al-
mazalim, al-sulh dan al-tahkim. Aspek lain yang disentuh seperti pendakwaan, perbicaraan, kaedah
pensabitan dan hukuman. Kursus ini juga melihat aplikasi teori kehakiman Islam dalam realiti
semasa di Malaysia dengan sedikit perbandingan dengan sistem kehakiman beberapa buah negara
lain.

This course discusses the concept of al-qada', it’s basis, background and relation to the responsibility
to uphold justice. This is followed by the conditions and qualifications for the staff of the Court. The
discussion also includes institutions that have relation to justice such as al-hisbah, al-mazalim, al-
sulh and al-tahkim. Other aspects such as the prosecutions, trials, methods of proving and
punishment are also included. This course also looks at the application of the theory of Islamic
Judiciary system in the Malaysia context with minor comparisons with the judicial system in several
other countries.
