IIM4006EQUITY AND TRUSTS

This course deals with basic principles relating to equity and trust consisting of concept, definition of
equity and trust , their categories, creation, administration and management and finally breach of trust .
It will also look into the development of the law and the extent of their application under Malaysian law.
Similarly , the course will delve into necessary comparisons to the Islamic concept of equity and trust,
their creation, court jurisdiction and the prospect of application in Malaysian law.

Course Learning Outcomes
At the end of this course, students are able to:
1. Explain the concept of equity and trust according to civil law and Islamic law
2. Examine the law applicable relating to equity and trust in Malaysia
3. Analyze the similarities and differences between basic equity and trust principles under both civil
law and Islamic law
4. Apply the relevant law of trust in resolving trust issue and problems in daily life

1. Para pelajar akan mempelajari undang-undang harta intelek di Malaysia merangkumi perkara-
perkara utama berikut:
2. Pengenalan undang-undang harta intelek secra keseluruhan – hak cipta, cap dagangan, paten,
dan rekacipta industri. Prinsip –prinsip umum harta intelek dari perspektif undang-undang
muamalat.
3. Hak cipta— prinsip-prinsip asas , kelayakan , tempoh masa perlindungan , pemunyaan dan
pemilikan hak cipta serta perlanggaran.
4. Cap dagangan – prinsip asas , kelayakan pendaftaran, pemunyaan dan pemilikkan cap dagangan,
pelanggaran dan remidi.
5. 4.Paten- prinsip asas, pendaftaran, pemunyaan, dan pemilikan paten, perlanggaran dan remedi.
