KURSUS ELEKTIF PENGKHUSASAN (9 KREDIT)
IIM4008LAW AND ADMINISTRATION OF WAKAF
This course discusses the fundamental law of wakaf concepts according to the Islamic law
perspective.The discussion will involve the applicable laws for the administration and management of
wakaf property in Malaysia especially regarding the powers given to the States Islamic Religious Council
as its sole trustee in the country.The discussion will then concerns the legal and management of wakaf
property in Malaysia such as analysis on the statutory provisions relating to the property,its legal
principles, provisions relating to family wakaf,issues on land development and wakaf propert, application
of istibdal concept and jurisdictional conflicts between shariah and civil courts in the said matter. Basic
drafting of wakaf documents and contract is also taught to the students.
Course Learning Outcomes
At the end of this course, students are able to:
1. Explain the concept and fundamental principles regarding wakaf according to Islamic law.
2. Identify the law enforced in the administration of wakaf in Malaysia including exposure the Shariah
and Civil courts’ jurisdictions in handling wakaf cases.
3. Explain how wakaf is administered in Malaysia especially the powers of the Islamic Religious
Councils and the Department of Wakaf, Zakat and Hajj in administering the said property.
4. Apply basic wakaf documentation contract by applying the relevant laws and Hukum Syarak.
5. Analyse problems and issues of wakaf its solution

IIM4009 LAW AND FATWA IN MALAYSIA
This course aims to expose the students to the role of fatwa in Malaysian law. Student will also be
exposed to the process and procedure of producing and gazetting fatwa in accordance with the provision
of law. Several issues involving fatwa such as enforcement, status as small law, public and government’s
acceptance and adherence to fatwa will also be discussed.
Course Learning Outcomes
At the end of this course, students are able to:
1. Explain the definition and the status of fatwa in the context of Islamic and Malaysian law
2. Explain the process and the method to produce and gazetting the fatwa
3. Analyze the effect of the fatwa on the aspect of execution, enforcement and obedient
