IIM3004 ISLAMIC LAW OF EVIDENCE
This course exposes the students to the basic concepts regarding al-bayyinah, evidence and facts. This
is followed by a description of some elements in proving such as the concept of burden of proof, the
parties bear the burden of proof and degree of proving. Students are also exposed to comparative
analysis between the concept of evidence in fiqh literatures and the respective laws in Malaysia. All
theoretical aspects, whenever relevant will be applied in Shariah Court cases.
Course Learning Outcomes
At the end of this course, students are able to:
1. identify the concept of al-bayyinah, evidence, classification of evidence and facts.
2. explain all aspects related to proving including the concept of prove, who bear the burden of prove
and degree of proving
3. apply all the principles of evidence and proving in Syariah Court cases.
4. analyzing the concept of evidence in Fiqh literatures and respective provisions of the law relating
to evidence.

IIM4001 SHARIAH CRIMINAL PROCEDURE LAW
This course introduces the students with the procedures regarding pre-trial, trial and post-trial in the
Syariah court. Beginning with complaints from public and how to deal with them. Students will also
understand the prosecuting procedures, how to present judgement and sentencing, as well as appeal
and revisionary power.
Course Learning Outcomes
At the end of this course, students are able to:
1. Explain the syariah criminal jurisdiction and the responsibility of enforcement agency, prosecution
and Syariah Court
2. Apply the relevant procedures in the right situation
3. Evaluate shortage and procedural loopholes in the agencies and suggest some recommendations
to overcome.
4. Analyse the importance of Syariah criminal procedure in criminal justice process.
